Some figure that when it's time to deal with it they will just get a lawyer if needed. Benjamin Franklin once quipped that an ounce of prevention is better than a pound of cure. This is especially true when it comes to legal matters. Law is one of those areas that changes slowly because it's foundational so people are hesitant to change. Certainty is valued more than convenience.

Let me preface this by stating that the following does not represent legal advice. If you need that certainty, please seek out and retain legal advise for the areas and jurisdictions that you do your business. 

When it comes to e-signing, I think it OK (at least in the US) to move forward with incorporating it into your business practices so long as you are careful about it. Here is what I do:

  • If I do a paper release, I scan  and keep the original. Paper has proven precedence so I still use it. I have a Neat Desk scanner (highly recommended) so it's easy to scan in a paper document in to a PDF
  • If e-signing, I use a 3 party service (I use SignNow) and print out a copy. Using the basic plan, I can scan and upload a print copy of the Shoot Agreement and have them sign in in advance of the shoot or on my iPad or iPhone at the shoot using the SignNow app.

As for signing on an iPad only based Model Release apps, I'm not as comfortable using those and I am with the SignNow service. Erring on the side of caution, I like that I can prove that an e-document was executed and uploaded to a third party source so that any claim of alteration to the file can be challenged using the time stamp of the upload.
